GENERAL TERMS AND CONDITIONS OF SALE
 

Prices
APB Modular (APB) quoted prices are firm for the period stated on the quotation. Where the purchaser accepts the quotation within the currency period of the quotation, but commencement of the building is delayed by statutory authorities or any other reason beyond the control of APB for more than 30 days from the acceptance date, the price for the building and any associated works will be subject to rise and fall of costs in materials and labour applicable at the time the building is ready to commence.
 
Warranty
APB Modular’s new products are covered by a twelve month warranty against defective materials and workmanship on condition that all the terms of quotation, including payment terms are met.  Any repairs, modifications or additional work carried out without the authority of APB Modular will be at the purchaser’s own risk and expense. APB Modular will not accept any responsibility for such work and the warranty will be considered null and void. Buildings that are second hand are not covered by warranty and are sold on the basis of condition as inspected by the purchaser.
Appliances, equipment and accessories purchased by APB Modular and incorporated into equipment manufactured by APB Modular or delivered separately will only be subject to any warranty given by the original manufacturer.
 
Council Fees
The purchaser shall be responsible for all fees, permits and certificates required by local councils or any other statutory authorities.
 
Manufacture and Delivery
Buildings will not be commenced until all relevant documents are completed and fittings and finishes selected to allow the building to be commenced, completed and installed without delay.  Factory scheduling can only be based on project files that have all necessary approvals, certificates, plans and specifications completed.
Delivery or handover will not take place until all terms of payment are completed.
 
Where delivery is included in the quoted price, APB Modular will advise by telephone, the date and approximate time of delivery. Should the truck be unable to unload at site without delay, any additional costs incurred will be charged to the purchaser.  If delivery of any goods is delayed at the request of the purchaser for more than seven days, payment shall become due as if the goods were despatched on the due date and a storage charge of $2.00 per square metre per week may be charged until the goods are despatched plus any relocation and weatherproofing costs from our factory to our storage yard.
 
Title
APB Modular shall retain title of any goods supplied until it has received full payment for them.  Goods belonging to APB Modular shall be stored so that they are identifiable as such. APB Modular’s retention of title to goods shall not affect its right as an unpaid Seller.  If payment is overdue, APB Modular shall be entitled to repossess goods belonging to it and enter any premises without notice for this purpose.  The purchaser is not permitted to dispose of the goods until they are paid for without the prior consent in writing of APB Modular.
 

Engineering Certification
All APB Modular buildings are constructed to designs approved by a consulting structural engineer.
Where the purchaser, statutory authority, or any other body requires a certificate of compliance with any standard or code; unless the cost of such certificate is expressly covered in the quotation, the cost of procuring the certificate or any other relevant documentation and any subsequent costs borne through the requirements  of these certificates shall be payable by the purchaser.
 
Fittings and Fixtures
Where a building supplied by APB Modular includes exit lights, emergency lights, or any other electrical installation that is required by a statutory authority to be tested, after connection to main power, all testing work is to be organised and paid for by the customer unless otherwise specified in writing by APB Modular.
Where buildings are supplied that require thermostatic mixing values or any other plumbing device, that under statutory codes require fitting and testing on site by a licensed plumber, the customer is to arrange and pay for supply, fitting and testing of such devices, unless otherwise specified in writing by APB Modular.
We provide poly-butelene piping for hot and cold water with rating’s of DN 18 and DN 20.  Hydraulic design for work completed in our factory provides for a minimum of 500 kpa water pressure to the building.  Information pertaining to hydraulic design exterior to the building or any special requirements must be provided to APB Modular prior to finalisation of scope of works and inclusions.
Unless performance requirements are expressly requested prior to commencing work, APB Modular takes no responsibility for poor performance of any electrical, hydraulic, mechanical, fire, communication, or security equipment.
 
General
APB Modular recommends that all portable buildings be tied down.  A quotation for this work can be provided if required.
Where specific performance characteristics or special statutory authority regulations apply which require variation to the standard specification of the goods, it is the client’s responsibility to provide the full information required to meet these requirements, and to meet any expenses by way of engineer’s or other specialists fees and charges as well as meeting the cost of any materials and labour necessary to achieve the design characteristics or statutory authority requirements.
APB does not warrant or guarantee any goods that are used in a way not covered by normal use, or as set out in any offer by APB covering special performance characteristics.
 
Payment
If any monies remain unpaid after the due date, an interest charge of 3.5% per month (market rental rates) of the unpaid amount will be payable by the purchaser on the overdue amount.
Delivery or handover will not take place until all terms of payment are completed.
 
If the client requires APB Modular to invoice a leasing company, APB Modular must be advised at the time of ordering.  All lease documents must be completed prior to delivery.  Any extra costs incurred, or delays in payment through not meeting these requirements will be payable by the purchaser.
